Taglich werden sie von anderen Unternehmen beauftragt, um spezielle Aufgaben fur sie zu erledigen, entweder aus Qualitatsgrunden oder weil es sich fur die Unternehmen nicht lohnt, diese selbst zu erfullen. In dieser Arbeit wird die rechtliche Vertragslage eines Subunternehmers naher erlautert. Hier wird den Fragen auf den Grund gegangen, ob neben dem beauftragenden Unternehmen noch weitere Unternehmen an der Subunternehmer-Konstellation beteiligt sind, mit wem in diesem Fall Vertrage zustande kommen und wie selbstandig diese rechtlich sind. Ferner werden die beiden rechtlichen Grundlagen beschrieben, nach denen ein Subunternehmervertrag abgeschlossen werden kann und unter welchen Voraussetzungen eine Vertragsbeziehung mit einem Subunternehmen uberhaupt zustande kommen darf. Des Weiteren wird geklart, wie aussichtsreich die Position des Subunternehmens in der Baubranche ist und welche Risiken den Subunternehmer nach Vertragsabschluss erwarten. Im Hinblick darauf wird schliesslich abgewagt, ob es sich lohnt ein Subunternehmen mit baugewerblichem Schwerpunkt zu grunden, oder ob eine gewoehnliche Unternehmung aufgrund der Risikobehaftung eines Subunternehmens nicht doch die bessere Alternative darstellt.
